Buying in Mallorca

Buying a home in Mallorca as an American, step by step

What happens between the first viewing and the keys, what it costs on top of the price, and where buyers from the US usually lose time.

Mallorca insights · Updated October 2026 · 8 min read

Spain places no restrictions on Americans buying property. You can buy in your own name, jointly, or through a company, and you do not need to live in Spain. What you do need is a Spanish tax number, a Spanish bank account and an independent lawyer, in that order.

Two things that changed recently

The proposed tax on non-EU buyers is not law. In January 2025 the Spanish government proposed a tax of up to 100% on homes bought by non-EU buyers who do not live in Spain. The bill has not been debated in Congress and was left out of the government's housing package in January 2026. Buyers from the US pay the same purchase taxes as everyone else.

Buying no longer gives residency. Spain closed its Golden Visa on 3 April 2025. A home in Mallorca is yours to use, but stays of more than 90 days in any 180 need a visa of their own.

The process

  1. Get your NIE. The NIE is the tax identification number for foreigners. You need it to sign at the notary, pay the purchase tax and open a bank account. You can apply at a Spanish consulate in the US, in person in Spain, or through a lawyer with a power of attorney. Start this first: it is the step that most often delays American buyers.
  2. Open a Spanish bank account. The purchase price can be paid from the US, but taxes, utilities and community fees are paid locally.
  3. Appoint an independent lawyer. Your lawyer works for you, not for the seller or the agent. Before you sign anything binding, the lawyer checks the Land Registry extract (nota simple) for ownership and charges, that the registered and built areas match the cadastre and the building licence, that local taxes and community fees are paid, and, if you plan to rent, whether the home has a holiday rental licence.
  4. Reserve and sign the private contract. A reservation takes the home off the market while the checks are done. The private purchase contract (contrato de arras) usually comes with a deposit of around 10%. If you walk away, you lose the deposit. If the seller walks away, the seller typically pays it back twice.
  5. Complete at the notary. The balance is paid and the deed (escritura) is signed before a Spanish notary, who then sends it to the Land Registry. You do not have to be there: you can sign through a power of attorney given to your lawyer.

What it costs on top of the price

For a resale home in the Balearic Islands, the main cost is the property transfer tax (ITP). It is charged in bands on the purchase price:

Part of the priceRate
Up to €400,0008%
€400,000 to €600,0009%
€600,000 to €1,000,00010%
€1,000,000 to €2,000,00012%
Above €2,000,00013%

On a €1.5 million home, that is €150,000, or 10% of the price. On a €3 million home it is €340,000. New builds bought from a developer are different: you pay 10% VAT plus stamp duty instead of ITP.

Notary, Land Registry and an independent lawyer typically add 1.5% to 2% together. If you finance part of the purchase, the bank's valuation and fees come on top.

If you plan to rent it out

Short holiday lets in Mallorca need a tourist rental licence, and new licences are capped. If rental income matters to you, buy a home that already has a valid licence and have your lawyer confirm it. Rentals of a month or longer do not need one, which is how many owners cover their costs while they are away.

How we work

Every home in the Mallorca Collection has a verified file and a lead agent on the island who knows the owner and the house. Morten is your advisor in Miami from the first call to the notary, so you deal with one person you know, in your own time zone.
