Taxes

Owning a home in Mallorca: your US and Spanish taxes

Two tax systems apply. The US–Spain tax treaty prevents most double taxation, but only if you file correctly in both countries.

Mallorca insights · Updated October 2026 · 9 min read

As a US citizen or resident you are taxed by the US on your worldwide income. As the owner of a home in Spain you are also taxed by Spain on that home, whether or not you rent it out. The tax treaty between the two countries, in force since 1990 and updated in 2019, decides who taxes what and lets you credit Spanish tax against your US tax.

In Spain, while you own the home

Even if you never rent it out, Spain taxes the home. Non-residents pay income tax on a notional income of 2% of the home's cadastral value (1.1% where the value has been revised). For residents of countries outside the EU, the rate is 24%. On a cadastral value of €500,000 that is €10,000 of notional income and €2,400 of tax a year, filed on form 210. The cadastral value is set by the state and is usually well below the market price.

Local property tax (IBI) is paid to the town hall every year, as in any US county.

Wealth tax. Spain taxes non-residents on the net value of their Spanish assets. The national allowance for non-residents is €700,000. Since 1 January 2024 the Balearic Islands allow €3 million per person, and non-residents can generally choose the rules of the region where most of their Spanish assets are. Above €3 million a national solidarity tax applies, with the wealth tax credited against it. Whether the Balearic allowance applies to you is a question for your adviser before you buy, because it shapes how the purchase should be structured.

In Spain, if you rent it out

Residents of countries outside the EU pay 24% on gross rental income, without deducting costs. Recent case law has challenged the ban on deductions, so it is worth asking an adviser whether you can claim them. Rental income is declared on form 210.

In Spain, when you sell

Non-residents pay 19% on the gain. The buyer withholds 3% of the price and pays it to the Spanish tax agency on your behalf. That 3% is an advance, not an extra tax: it is set against what you owe, and any excess is refunded. The town hall also charges a tax on the increase in land value (plusvalía municipal).

In the US

  • Rental income goes on Schedule E, as with a US rental. Residential rental property outside the US is depreciated over 30 years.
  • Spanish tax paid on the same income can usually be claimed as a foreign tax credit (Form 1116), so you are not taxed twice on it.
  • A sale is taxed in the US as a capital gain, measured in dollars. A move in the euro–dollar rate can create a US gain, or reduce one, even if the euro price has not changed.

Reporting you should not miss

  • FBAR. If your foreign accounts together exceed $10,000 at any point in the year, you file an FBAR. Your Spanish bank account counts.
  • Form 8938. Foreign financial accounts above the FATCA thresholds go on Form 8938. A home you own directly does not.
  • Owning through a company changes the picture on both sides, with heavier reporting in the US. Decide on the structure before you sign, not after.

The practical answer

Use one adviser who works across the US and Spain, or two who talk to each other. We work with cross-border advisers and can introduce you before you make an offer.
